• Caritas opposed the original form of the Bill in 2009 and continues to oppose the revised version.
• Caritas considers that the imposition of the maximum penalty for a "third strike", regardless of circumstances and mitigating factors will result in hugely disproportionate outcomes.
• Caritas believes that judicial discretion is the most appropriate way of deciding a just penalty.
• The legislation fails to promote repentance and rehabilitation over revenge.
